POSITION CONCEPT: 
The Contract Manager serves as a functional manager responsible for the accurate preparation, negotiation, award, and commercial management of contract formation and administration of various high dollar, complex and high risk engineering and construction contracts; engineered equipment contracts for capital and maintenance projects related to electric power generating facilities, electric transmission and distribution facilities, environmental, natural gas delivery facilities, technology (software, services, licensing, hosting, hardware and other related activities) and/or other corporate contracts to support all TECO Energy companies. Provides guidance to develop and maintain form work (bidding, contract forms, commercial terms and conditions suitable for the specific procurements contemplated) as well as processes and procedures as needed to facilitate the award of such contracts. Also provides support and leadership in negotiating terms and conditions for the contracts contemplated.

 

DUTIES AND RESPONSIBILITIES: 
1. Provide supervision, direction, training, and development of assigned direct reports.

2. Lead the project contracts team in the development of the procurement plan from specification issue, RFP issue, contract award, delivery and close-out for all capital and maintenance projects to include multiple prime contracts. The above planning and decision process is successfully accomplished through accurate and timely application of procurement and/or contracting knowledge and experience.

3. Assist and advise project management teams during the preparation of technical specifications and/or scopes of work by performing reviews and assistance in support of development of such technical specifications and/or scopes of work.

4. Lead the project contracts team in the performance of due diligence of potential new service providers confirming the technical and commercial where-with-all to take on and successfully complete contract requirements.

5. Develop and maintain formal processes and procedures for the formation and administration of engineering and construction contracts and engineered equipment contracts as well as contracts for maintenance and consulting services and/or technology related project contracts (software, services, licensing, hosting, hardware).

6. Develop purchasing and contract standards including bid invitation, bid evaluation, purchase order and contract terms and conditions that will be utilized throughout the company.

7. Ensure that contracts activities are performed in accordance with established policies and procedures.

8. Assist and advise team members in the area of contractual risk and risk mitigation. Function as the subject matter expert with the Legal and Risk Management departments for the contract team.

9. Maintains professional and technical knowledge by attending educational workshops and seminars, reviewing professional publications, and participating in professional organizations.


EDUCATION:

Required: Bachelor degree in Business, Engineering, Supply Chain, Information Technology or related field.

Preferred: Masters of Business, Master of Science, or JD degree.

 

EXPERIENCE:
Required: Ten years of experience in contract formation and administration, risk analysis, and contract negotiations in an industrial construction environment or information technology area.

 

KNOWLEDGE/SKILLS/ABILITIES:
Required: Extensive knowledge of construction and/or technology contract law and extensive experience negotiating, writing and administering contracts for technology, architect/engineer services, construction services, and major engineered equipment. Knowledge and experience in delivery methods such as design-build, EPC, design/engineer, construction, design and furnish with technical direction of installation; and experience with different contract types such as lump sum, unit price, cost plus fixed fee and cost plus incentive fee. Demonstrated knowledge and experience in contract formation, contract administration and management, contract claims and disputes resolution.
