This position is open to internal and external candidates, and will close Monday, 03/27/2023.
The pay rage for the Right of Way Agent is $62,200 to $77,750, and the pay range for the Senior Right of Way Agent is $74,880 to $93,600. Placement is based on skills, experience and education of the successful candidate.
POSITION CONCEPT
This position will serve as the real estate contact and provide real property support for matters related to the company’s operations. A right-of-way agent negotiates and acquires real property interests for the use and benefit of the company while also maintaining the company’s real estate records.
ADVANCEMENT IN PROGRESSION
Progression to the next level is based on direct observation of the employee’s performance, qualifications, and the business and/or technical needs of the department subject to Supervisor approval. Advancement is not automatic or based solely on time in position.
AGENT, RIGHT-of-WAY
Under general supervision, negotiates, obtains, and preserves rights-of-ways (ROWs) and other property rights from public and private entities.
PRIMARY DUTIES AND RESPONSIBILITIES
1. Performs thorough and accurate title and property searches including the completion of thorough and accurate property title searches, right-of-way records, documents, and title chains to make determination of existing land rights.
2. Identifies, locates, and initiates real estate negotiations with individuals and other various entities.
3. Conducts productive negotiations internally with associates and externally with customers, including public and private entities, for the acquisition of real property rights.
4. Produces and obtains easements, ROW documents, letters, maps, drawings, and other written materials.
5. Reads and interpret real estate survey legal descriptions and corresponding exhibits, subdivision maps, parcel maps, work orders, various construction drawings and engineering drawings.
6. Interprets and assists in the production of engineering surveys and legal documents related to ROW acquisitions and disposals.

Key External: Works with vendors, contractors, customers and state, federal and tribal governmental agencies

Education
Required: Bachelor’s degree. Additional experience may be considered in lieu of a degree (see experience below).

Required: Ability to read and interpret documents such as easement/property description, surveys, engineering plans, safety rules, operating and maintenance instructions, technical and procedure manuals. Ability to negotiate transactions and gain concessions while maintaining positive client relationships.
AGENT, RIGHT-of-WAY SENIOR
Under limited supervision, negotiates, obtains, and preserves right-of-way (ROW) and other property rights from state, federal, and tribal public and private entities, while providing strategic support to manage the company’s real estate portfolio and capital improvement initiatives. Senior agents assist with the coordination, planning and execution of project delivery, achieving high-quality performance through a solution-driven decision-making process. To include performing all duties of the Agent, Right-of-Way, in addition to the duties listed below.
PRIMARY DUTIES AND RESPONSIBILITIES
1. Responsible for overseeing, reviewing drafting, and negotiating contractual packages for acquiring various property rights through grants of easements, purchase agreements, leases, licenses, permits, etc. to facilitate the construction, operation and maintenance of facilities and site acquisitions.
2. Leads projects, acts as a subject matter expert (SME) in the technical aspects of real estate negotiation, ROW permitting and the eminent domain code of the State of New Mexico.
3. Provide leadership from conception to completion on ROW projects (of varying size and complexity) running concurrently.
4. Lead project teams in defining and sequencing activities, estimating budgets and tasks, and building the overall plan to achieve project objectives.
5. Communicate project information and status to all stakeholders and escalate appropriately.
6. Ability to write drafts complex reports, business correspondence, and procedure manuals.
7. Provides technical support and acts as a SME in eminent domain actions against real property within the State of New Mexico and utility permitting practices in accordance with the Requirements for Occupancy of State Highway System Right-of-Way by Utility Facilities .
8. Obtains ROWs in accordance with the Federal Land Management Policy Act (FLPMA) of October 21, 1976, Title 25 Code of Federal Regulations, Part 169, and Title 25 United States Code §§ 323-328.

Key External: Works with vendors, contractors, governmental agencies, and customers (including state, federal, and tribal government) as well as appraisers, surveyors, and various other vendors
QUALIFICATIONS
Education
Required: Bachelor’s degree. Additional experience may be considered in lieu of a degree (see experience below).
Licenses/Certifications
Required: Must possess a valid driver’s license and meet the acceptable driving record requirements of the Company.
Preferred: Senior ROW Professional (SR/WA) Designation from the International ROW Association (IRWA) or Project Manager Professional (PMP)

Required: Expert knowledge of current real estate transaction practices, property records (research and maintenance) and Geographic Information System (GIS) mapping applications. Strong verbal, written, analytical, and interpersonal skills. Ability to oversee moderately complex projects and activities with limited discretion. In-depth knowledge of industry, standards, rules, and regulations governing the utility industry and real estate practices and laws including utility condemnation of real property. Ability to research independently. Ability to demonstrate advanced negotiation skills. Ability to maintain positive and productive working relationships with various individuals and groups. Ability to effectively present information in one-on-one and group situations.

WORKING CONDITIONS
Office and field environment. Most work is completed during normal working hours with some outdoor field and site visits are required from time to time, including overnight travel.
PHYSICAL DEMANDS
Ability to stand or walk up to 1/3 of the time and regularly required to sit up to 2/3 of the time. Manual dexterity required, good vision, and the ability to talk and listen. Ability to stoop, kneel, crouch, crawl, climb, and balance. May occasionally lift and/or move up to 30 pounds. May be exposed to outdoor weather conditions when working in the field.
